1. Introduction & Acceptance

Welcome to EVA (referred to herein as EVA, we, us, or our), a clinically guided longevity platform developed and operated by Elite Vita, a Dubai-based health and wellness company. EVA is accessible via the EVA mobile application (App Store and Google Play), the web application at eva.ae, and associated services (collectively, the Platform).

By accessing or using the Platform, creating an account, purchasing a subscription, or engaging with any EVA service – including DNA testing, blood biomarker analysis, personalised supplement protocols, DEVA daily insights, or clinical consultations – you agree to be bound by these Terms and Conditions (Terms). If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Elite Vita (trading as EVA), registered and operating in Dubai, United Arab Emirates.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Reside in or be visiting the UAE, GCC, UK, Europe, or any other jurisdiction where EVA services are available
  • Provide accurate, current, and complete information during registration and at all times thereafter

EVA is not intended for individuals under 18. By creating an account, you confirm you meet all eligibility requirements.

3. The EVA Platform & Services
3.1 What EVA Provides

EVA is a clinically guided longevity platform that integrates three pillars of biological data into a unified health optimisation experience:

  • DNA (Your Past): Genetic analysis of 1M+ mutations revealing inherited predispositions and optimal health pathways
  • Blood (Your Present): Analysis of 70+ blood biomarkers reflecting your current biological state, conducted through medically supervised testing
  • Supplements (Your Future): Personalised supplement protocols delivered to your door, clinician-reviewed and adjusted based on ongoing biomarker data

The DEVA (Daily EVAluation) engine delivers three daily insights, actions, and outcomes – connecting you to your biology in a manageable, meaningful way. All protocols are reviewed by qualified clinicians as part of EVA’s clinician-in-the-loop model.

3.2 What EVA Is Not

EVA is explicitly not:

  • A medical device or licensed medical treatment
  • A replacement for your GP, specialist, or any licensed healthcare provider
  • A diagnostic tool for disease or medical conditions
  • An emergency health service

EVA complements – but does not replace – professional medical care. If you are experiencing a medical emergency, call emergency services immediately.

3.3 Supplement Delivery

Supplement fulfilment is managed through Elite Vita’s Dubai-based operations with international shipping capabilities. Delivery timelines, shipping terms, and availability may vary by region. Supplements provided are not pharmaceutical drugs and are not intended to diagnose, treat, cure, or prevent any disease.

4. Subscriptions, Pricing & Payments
4.1 Pricing Structure

EVA operates a premium subscription model. Current pricing (subject to change with notice) includes:

  • Core Package: USD 1,999 – includes DNA testing, blood testing (70+ biomarkers), and a 6-month follow-up blood test
  • Supplement Subscription: USD 199/month – personalised supplement protocol delivered monthly
  • Doctor Consultation: USD 200 per session
  • Additional Blood Test: USD 399
  • Peptide Consultation: USD 99
  • Corporate Wellness Packages: Custom pricing – contact EVA directly
4.2 Payment Terms

All payments are processed securely through EVA’s authorised payment providers. Prices are displayed in USD unless otherwise stated. By purchasing a subscription or service, you authorise EVA to charge your selected payment method. Subscription fees are billed in advance on a recurring basis.

4.3 Cancellations & Refunds

Subscription cancellations must be made at least 7 days before the next billing cycle to avoid charges for that period. Due to the clinical and personalised nature of EVA services – including DNA testing, blood analysis, and custom supplement protocols – refunds are assessed on a case-by-case basis. DNA and blood testing fees are non-refundable once the testing process has commenced. Supplement orders already shipped are non-refundable. Please contact support@eva.ae for all refund enquiries.

4.4 Price Changes

EVA reserves the right to modify pricing at any time. Existing subscribers will receive at least 30 days written notice before any price increase takes effect.

5. User Accounts & Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring all information you provide is accurate and up to date
  • Notifying EVA immediately of any unauthorised account access

EVA reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to the Platform or other users.

6. Health Data & Clinical Oversight

By using EVA, you acknowledge and agree that:

  • You voluntarily provide biological and health data (including DNA samples and blood samples) for analysis within the EVA Platform
  • All protocols and recommendations are reviewed by qualified clinicians but are wellness-focused optimisation tools, not medical diagnoses or treatments
  • Individual results vary – EVA does not guarantee specific health outcomes
  • Claims referencing biological age improvement are based on Elite Vita clinic data and individual results may vary
  • You should always consult your own healthcare provider before making significant changes to your health regimen
7. Intellectual Property

All content on the EVA Platform – including the EVA name, DEVA system, brand assets, algorithms, reports, UI design, educational content, and the three-pillar framework – is the intellectual property of Elite Vita and protected by applicable UAE and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any EVA content without prior written consent. Your personal health reports and data remain yours; however, EVA retains rights to anonymised, aggregated data for research and platform improvement purposes as outlined in our Privacy Policy.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of UAE law
  • Attempt to reverse-engineer, decompile, or hack any aspect of the Platform
  • Share, resell, or sublicense your EVA account or subscription
  • Provide false health or identity information
  • Interfere with the Platform’s security, integrity, or functionality
  • Use EVA data to make unsupervised medical decisions without clinical guidance
9. Disclaimers & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW:

  • EVA provides services on an as-is and as-available basis
  • EVA does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components
  • EVA is not liable for any indirect, incidental, special, or consequential damages arising from use of the Platform
  • EVA’s total liability for any claim shall not exceed the amount paid by you for services in the three months preceding the claim

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Third-Party Services

EVA may integrate with or reference third-party services (e.g., laboratory testing partners, payment processors, app distribution platforms). EVA is not responsible for the practices, content, or privacy policies of third-party services. Use of such services is at your own risk and subject to their own terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates, specifically as applicable in the Emirate of Dubai. Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Dubai, UAE.

12. Changes to These Terms

EVA reserves the right to update these Terms at any time. We will notify you of material changes via email or in-app notification at least 14 days in advance. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
